1. About Here Aware

Here Aware is a registered independent mindfulness practice operated by Joyce Octavo, registered autónoma in Spain. Here Aware offers nature-based mindfulness experiences and physical products through hereaware.com.

By using this website, booking a session, or purchasing a product, you agree to these Terms & Conditions.

2. Services Offered

Here Aware offers the following services:

2a. Birdsong Walks (Group & 1:1)

Slow, mindful outdoor walks guided by birdsong and natural sound observation, offered in parks around Barcelona. Group walks are free to attend with a donation suggestion. Private 1:1 walks are available by appointment.

2b. Social Birdwatching Events

Community birdwatching outings focused on observation and curiosity, held monthly. Free to join with a donation suggestion. Field guides and birdwatching tools may be available to purchase at events.

Children are welcome at Social Birdwatching events when accompanied by a parent or legal guardian. The accompanying adult is fully responsible for the child's safety, behaviour, and wellbeing throughout the event. Here Aware does not assume supervisory responsibility for any child attending.

2c. Reiki Sessions (In-Person & Distance)

  • Initial consultation (indoor): €20

  • 4-session pack (indoor): €100 (first session deducted from total)

  • Initial consultation (outdoor/nature): €15

  • 3-session pack (outdoor): €70 (first session deducted from total)

  • Distance Reiki: available by appointment

Reiki is offered as a complementary practice and is not a substitute for medical or therapeutic care.

2d. Mindfulness Meditation Sessions (1:1 & Group)

Guided mindfulness meditation practices offered one-to-one or in small groups, exploring different forms of attention. Pricing and format agreed individually. Contact hereaware.com/contact to arrange.

2e. Customised Experiences

Bespoke 1:1 or group mindfulness experiences can be arranged on request. These are agreed individually in terms of content, duration, location, and price. A written confirmation of the arrangement will be provided before the session takes place.

3. Bookings and Appointments

  • Sessions are booked via the booking link at hereaware.com/reiki or by contacting us directly at hereaware.com/contact

  • Bookings are confirmed once you receive a confirmation from Here Aware

  • Please arrive on time. Late arrivals cannot be guaranteed a full session

  • For distance Reiki, please ensure you have a quiet, comfortable space available for the duration of the session

  • Here Aware reserves the right to decline or cancel a booking at its discretion

4. Cancellation & Rescheduling — Sessions

Cancellations by you:

  • More than 48 hours before the session: full refund or reschedule, no charge

  • 24–48 hours before the session: reschedule offered; refunds at our discretion

  • Less than 24 hours before the session: no refund. Rescheduling may be possible depending on availability

Cancellations by Here Aware:

  • If Here Aware cancels a session, you will receive a full refund or the option to reschedule

  • Outdoor sessions (including Birdsong Walks and Nature Reiki) may be cancelled due to adverse weather. We will notify you as soon as possible and offer an alternative

Shipping:

We ship to Spain (Península and Islas Baleares) and selected European countries including Portugal, France, Germany, Netherlands, Belgium, Italy, United Kingdom, Ireland, Sweden, Denmark, Norway, Switzerland, Austria, Czechia, Bulgaria, Romania, Lithuania, Slovenia, Slovakia, Poland, Iceland, and more. Shipping is also available to the US and UK.

Shipping costs are calculated at checkout based on your location. Local collection in Barcelona is available free of charge at a Birdsong Walk or Reiki session — select this option at checkout.

We are not currently shipping to the Canary Islands, Ceuta, or Melilla. If your country is not listed, please contact us.

Cancellations & Refunds — Journal:

  • Cancellations accepted within 24 hours of placing your order: full refund

  • After 24 hours: as this is a small print run, we are unable to offer refunds

  • If your journal arrives damaged or faulty: please contact us at hereaware.com/contact with a photo and we will make it right

  • We are not responsible for delays caused by postal services or customs

6. Digital Products — No Refunds

Here Aware may offer digital products including but not limited to: guided audio recordings, downloadable resources, digital journals, and online content.

All digital product sales are final. By completing a purchase of a digital product, you acknowledge and agree that:

  • No refunds will be issued once a digital product has been delivered, accessed, or downloaded

  • This applies regardless of whether the product has been used or opened

  • Digital products are for personal use only and may not be shared, reproduced, or redistributed

Under EU consumer law, the 14-day cooling-off period does not apply to digital content that has been accessed or downloaded with your prior consent and acknowledgement that the right of withdrawal is thereby lost. By purchasing a digital product, you confirm this consent.

If you experience a technical issue preventing access to a digital product, please contact us at hereaware.com/contact and we will do our best to resolve it.

6. Donation-Based Experiences

Group Birdsong Walks and Social Birdwatching events are offered free of charge. A donation is suggested at the end of the experience to help cover the cost of organising, including location fees, materials, and time. Donations are entirely voluntary — participation is always welcome regardless of contribution.

7. Health, Safety & Participant Responsibility

7a. Fitness to Participate — Your Declaration

By booking a session, purchasing a service, or attending any Here Aware experience, you confirm and declare that:

  • You are in a suitable physical and mental state of health to participate

  • You do not have any medical condition, injury, illness, or circumstance that would make participation unsafe or inadvisable without medical clearance

  • If you are unsure about your fitness to participate, you have consulted — or will consult — a qualified healthcare professional before attending

  • You will inform Here Aware of any relevant health conditions, injuries, or circumstances before a session begins

If you attend a session or experience without disclosing a relevant condition, Here Aware cannot be held responsible for any negative outcome.

7b. No Liability for Injury or Illness

Participation in all Here Aware experiences — including but not limited to Birdsong Walks, Social Birdwatching, Mindfulness Meditation, and Reiki sessions (in person or at distance) — is entirely at your own risk.

Here Aware, its founder, and any associated facilitators are not liable for any injury, illness, adverse reaction, physical discomfort, emotional distress, or any other negative outcome that arises during or after participation in any session or experience, including but not limited to:

  • Physical injuries sustained during outdoor walks or activities

  • Illness contracted before, during, or after attending a group experience

  • Any physical or emotional response to Reiki or mindfulness practices

  • Any aggravation of a pre-existing condition

By attending, you accept that you are participating voluntarily and that Here Aware has taken reasonable care in the design and delivery of its experiences.

7c. Reiki — Complementary Practice Disclaimer

Reiki is a complementary practice and is not a substitute for medical, psychological, or therapeutic treatment. Here Aware does not diagnose, treat, cure, or prescribe. Sessions are offered to support relaxation and general wellbeing only. If you have a medical or mental health condition, please consult your healthcare provider before booking.

Here Aware makes no guarantee of any specific outcome, experience, or result from Reiki sessions. Experiences vary widely between individuals.

7d. Outdoor Experiences

Outdoor experiences take place in public parks and natural spaces. Participants are responsible for their own safety, appropriate clothing, and suitable footwear. Here Aware is not liable for any injury, accident, or incident sustained during outdoor experiences as a result of participant actions, environmental conditions, or unforeseen circumstances.

7e. Children

Children attending Social Birdwatching events must be accompanied by a parent or legal guardian at all times. The accompanying adult assumes full responsibility for the child's safety, supervision, and wellbeing throughout the event. Here Aware does not provide childcare or assume any duty of supervision over children attending its events.

8. Intellectual Property

All content on hereaware.com — including text, images, audio recordings, and the Field Journal — is the intellectual property of Here Aware / Joyce Anne M. Octavo. You may not reproduce, distribute, or use this content without prior written permission.

The Field Journal is for personal use only. It may not be reproduced, photocopied, or resold.

9. Limitation of Liability

Here Aware provides all services and products in good faith and with reasonable care. To the fullest extent permitted by Spanish and EU law, Here Aware is not liable for:

  • Any injury, illness, physical discomfort, emotional distress, or adverse reaction arising during or after participation in any experience or session

  • Any negative outcome resulting from participation where a pre-existing health condition was not disclosed

  • Any indirect, incidental, or consequential loss arising from use of our services or products

  • Loss or damage resulting from circumstances beyond our reasonable control (including weather, third-party cancellations, force majeure)

  • The actions or omissions of third-party platforms (Squarespace, Stripe, PackLink, Meetup, WhatsApp, etc.)

Nothing in these Terms limits your statutory rights as a consumer under EU or Spanish law.

10. EU Consumer Rights

As a consumer based in the European Union, you have statutory rights that cannot be overridden by these Terms. These include:

  • The right to a 14-day cooling-off period for distance contracts (online purchases), with some exceptions

  • Rights relating to faulty or misdescribed goods

  • Access to the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr

For questions about your consumer rights, you may also contact the Spanish consumer authority (OMIC) in your local municipality.

11. Governing Law

These Terms & Conditions are governed by the laws of Spain. Any disputes arising from these Terms shall be subject to the jurisdiction of the Spanish courts, without prejudice to your rights as an EU consumer.

12. Changes to These Terms

We may update these Terms & Conditions from time to time. When we do, we will update the 'Last updated' date at the top of this page. Continued use of our services after changes constitutes acceptance of the updated Terms.
